Victory of Warakaris and the natives
Two cases were filed in the High Court on this issue; one by Shri. Kailas Panmand of Shindevasuli village and another by Shri. Sunil Dighe on behalf of ‘Warakari Sapmradaya’. DOW had also filed a case demanding for protection by the Grampanchayat as the road to the company’s project was passing through this village. Hearing of both the petitions took place before the Chief Judge Mohit Shah and Judge Dhananjay Chandrachood. Advocate Janak Dwarakadas informed the Court that owing to the strong opposition of the natives and warakaris, it would not be possible to run the factory; therefore, the plot of land taken from Maharashtra Industrial Development Corporation was handed back to the Corporation. The Bench passed verdict in both the cases.
It was the main demand of warakaris that the Company should declare what kind of research or product was to be manufactured in this project in Khed taluka. Accidents that had taken place in India right from the case of Union carbide were mentioned in the petition. The natives had demanded that similar danger could be posed even here; therefore, at least details about the company’s pilot plant should be declared; but the Company had opposed the demand and the natives had filed a case.
