HC issues order for conducting inquiry into management of Temples

Will the High Court issue orders for conducting inquiry into places of worship of non-Hindus?

Mumbai: There are many ‘Devasthana’ (Temples) in Maharashtra which undertake various types of activities. The State Government should conduct inquiry of all the ‘Devasthana’ and if they are of commercial nature, their registration should be done as commercial establishments. This action should be completed by May 2011. The above order has been issued by Mumbai High Court to the State Government.

The Labour Commissioner had directed, vide his order dated 22nd July 1996, that the ‘Devasthana’ at Akkalkot should be registered under the ‘Mumbai Shops and Establishments Act’. It was mentioned in this order that –‘ Devasthana’ has employed 35 workers for various jobs. ‘Devasthana’ has given few lockers on rent. It charges Rs. 10/- for meals. There are 20 employees catering food. ‘Bhakta-niwas’ is given for marriage ceremonies by charging Rs. 5000 =00 as rent. There are schools run by the ‘Devasthana’ which have got their separate staff; therefore, the ‘Devasthana’ is not a charitable institution but a commercial establishment. (‘Devasthana’ has undertaken the above welfare activities so as to utilize the money in proper manner. If the Labour Commissioner feels that there is misappropriation of funds, he should arrange to collect money and provide meals for Rs. 10/-. He should construct a hall and offer it to the poor for the rent of Rs. 5000/-. These things are not possible on a commercial basis.
