PIL filed by HJS against use of plastic National Flag

Mumbai High Court orders State Govt. to present their case    

Mumbai: On 26th January and 15th August, small national flags made of plastic are sold on large scale. Misuse of these flags leads to their abuse; therefore, Hindu Janajagruti Samiti (HJS) has filed PIL in Mumbai High Court. It was heard by the Bench consisting of Judges D. D. Sinha and V. K. Tahaliramani. The Court has issued a notice to the State Government to present its side and hearing of the case has been adjourned till 16th February.

It has been mentioned in this petition that ‘on the days of national festivals, national flags made of plastic are used and later found strewn all over the place on roads, garbage bins and gutters. This causes abuse of National Flags. Under the ‘National Emblems – Prevention of Improper Use Act, 1950’, clause 2 of ‘Prevention of insults to National Honour Act, 1971’ and ‘The Emblems and Names (Prevention of Improper Use) Act, 1950, it is a punishable crime to insult and abuse National Flag. Also, the law passed by the State Government on August 22, 2007 in this connection, is not implemented.’ The Bench of Judge D D Sinha and Judge Smt. Tahaliramani have issued a notice to the Chief Secretary of the State, Director General of Police, Secretary of the State Home Ministry and Secretary of Urban Development Department in this regard.
