High Court refuses permission for temporary slaughterhouses on Bakr-Id !

Mumbai : Even though it is a custom to slaughter goats on the occasion of Bakr-Id, High Court cannot give permission to erect temporary slaughterhouses in urban residential areas for this purpose. Although, this issue is connected with religious sentiments, it is equally concerned with the health of the citizens. Due to slaughter of animals at various places, stench will spread because of blood, useless flesh, and other ingredients; similarly there will be a pressure on sanitary system. Therefore, High court will not permit the erection of temporary slaughterhouses for three days in Muslim majority areas on the occasion of Bakr-Id. The judgement was delivered by Justice D. Y. Chandrachud and Justice A. A. Sayyad of Bombay bench of High Court. (Hindus, offer gratitude at the Holy feet of God for this ! – Editor SP)

A petition in this respect was moved by Mr. Samsherkhan Pathan, President Avami Vikas Party and ex-Police officer, and came for hearing today before the High Court bench.

Combined opposition by State Government and Municipal Corporation !

While submitting their say on the directives of High Court, the State Government and Municipal Corporation have clearly opposed the erection of temporary slaughterhouses. Advocate Ashitosh Kumbhkoni, representing Municipal Corporation, submitted that a policy decision has been taken on this issue in a high-power committee meeting under the chairmanship of Chief Minister.

Why insistence on personal presence while slaughtering goat ?

Advocate Kumbhkoni argued, “Deonar abattoir will be available day and night for 3 days. Still, why the Muslms should insist on personal presence during slaughter of goats after they carry their goats to abattoir ? It will create unnecessary traffic jams. When Hindus perform Abhishek (Consecration by ritualistic bathing with water, milk etc.) in temples, we just convey our names. The religious rite is completed by the resolve made; it is not necessary to remain present for during the ritual.”

This issue is also a dispute between Hindus and Muslims !

On this occasion, Advocate Omprakash Jha, representing Bharatiya Govansh Rakshan Sanvardhan organisation, argued, “Only such animals which do not prove useful for agricultural purpose are to be slaughtered; but Muslims slaughter healthy animals. The vehicles carrying such healthy animals have been detained on many occasions, and the objections have been raised by Hindus. Therefore, this issue pertains to the dispute between Hindus and Muslims. This has also caused communal tension many times.”

Committee to find lasting solution

Justice Chandrachud commented on the occasion, “The State Government should appoint a committee under the chairmanship of ex-administrative officer Mr. Ribello to find the lasting solution on the issue. The petition is kept pending and next hearing is scheduled for 21st January 2013.”

High Court permits intervention of Advocate Ishwarprasad Khandelwal !

 During the hearing of this case, founder of ‘Lashkar-E-Hind’ Advocate Ishwarprasad Khandelwal intervened with the permission of the High Court. In his intervention, Advocate Khandelwal submitted, “Bombay High Court cannot pass any order to administration against law. Mumbai city comes under the jurisdiction of Pollution and Control Act, hence, temporary slaughterhouses cannot be erected within city limits.”
