M F Hussain’s paintings put Nafisa Ali in dock

New Delhi: The Delhi High Court stayed the show-cause notice issued by a trial court against noted social activist Nafisa Ali for allegedly purchasing M F Hussain’s controversial painting depicting the Hindu goddesses in indecent manner.

Justice B N Chaturvedi stayed the show cause notice issued against her on May 15 on a complaint by a local Shiv Sena leader.

Senior advocate Siddhart Luthra, appearing for the actress, contended that the notice was issued to her before cognisance was taken in the matter.

"Metropolitan Magistrate has no power to issue show cause notice before the cognisance is taken in a case," the counsel said while challenging the Magistrate’s order.

The counsel further said that she did not purchase any such painting and even if she had, it would not have been a crime.

"There is no material to show that she purchased the painting and no evidence was placed before the the magistrate to prove the allegation," the counsel said.

Acting on a complaint filed by Shiv Sena leader Jay Bhagwan Goyal, the Metropolitan Magistrate Raj Kapur had directed the actress to file her reply on why action should not be taken against her.

The court also issued notice to the complainant and directed him to file reply by November 23.

Husain exempted of court appearance

New Delhi: The Delhi High Court on Thursday exempted noted painter M F Hussain from appearing in person before a city court on March 6 for allegedly portraying Hindu gods and goddesses in his works in an indecent manner and hurting religious feelings. Justice Ravinder Bhat asked Husain to mark his presence before the court of Additional Chief Metropolitan Magistrate (ACMM) through his counsel on Tuesday. The Court was hearing a revision petition filed by Hussain challenging the order passed by ACMM summoning him to personally appear before it in a batch of complaints filed against the painter. On February seven, while issuing summons, the ACMM had also pulled up the Delhi police for dragging their feet in investigating the complaints against Hussain.

Besides Hussain, the court had also summoned socialite Nafisa Ali in a complaint registered in Indore. All complaints which were filed against the painter have been transferred to Delhi after a Supreme Court order. A doctor of Apollo Hospital Ram Pratap Singh had filed a complaint accusing Husain of hurting religious feelings by painting "nude or scantily-clad" portraits of Sita, Draupadi and Bharat Mata."
