New Delhi : Despite Supreme Court’s orders issued twice, law related to Common Civil Code has not been implemented so far. Implement this Act immediately, was a strong demand made by Shiv Sena in Upper House of the Parliament. During discussions on the topic of working of ‘Law and Justice Department’, Shiv Sena leader and MP Shri. Sanjay Raut also demanded that clause 370 of Indian Constitution giving special status to Jammu-Kashmir State should be cancelled and name of Bombay High Court be changed to Mumbai High Court. MP Shri. Raut said, “Central Law Minister Shri. Ravishankar Prasad had given promise to hold discussions on Common Civil Code and he should keep his promise. In fact, only discussions have been held on this subject so far and now it is time for implementation. The Government should take necessary steps.”

What is the use of getting justice after one’s death ?

Shri. Sanjay Raut cited few cases while drawing attention of the House towards the fact of extremely slow process in getting Courts’ decisions, in our country. Justice should be done in one’s life-time and not after death.

He said…..

1. There are 3.14 crores cases pending in Indian Courts. Verdict on Koshipura case of Banaras was given after 130 years. Even in case related to Ayodhya, one had to wait for 114 years to get verdict. After 28 years, accused in Hashimpura case were acquitted.

2. What is the use of acquittal after such long delay ? Career and interest in life of all those accused must have been finished by then. It is therefore, necessary that the Government should at least now take steps for speeding up process of getting decisions from Courts.

3. The judicial system needs to come out of the outlook of ‘let hundreds of accused go scot-free but even a single innocent person should not be punished’.

4. In Pakistan, an anti-national like Masharat is immediately acquitted; then slogans are raised hailing Pakistan, Pakistan’s flags are hoisted; whereas a Saint like H. H. Asaramji Bapu has been languishing in jail for past 18 months. This discrepancy should be eliminated.

5. There are brilliant advocates like Arun Jaitley, Ravishankar Prasad, Tulasi sitting in this House. I have heard that these big advocates charge a lot of money by way of fees. What will a poor person do; from where will he raise so much money ? The Government should therefore, have control even the huge fees charged by advocates.

  1. 65 years passed begging for common civil code. Now minorities have started making fun of Hindus who are 80% and still not able to make a common civil code, ram temple and Hindu rashtra.
