Hindu journalist decides to go to SC to fight against M. F. Hussain

‘Bharatmata’ in nude drawn by M.F. Hussain has been put up on the website for sale. This act of Hussain has put all Indians to shame. A case has been filed by Shri. D. V. Varkhedkar, a correspondent with the First Class Magistrate, Pandharpur against M.F. Hussain. This case was transferred to the Supreme Court without giving a chance to Shri. Varkhedkar to present his side.

The Court at Pandharpur had issued an arrest warrant against Hussain; but that time, Mr. Hussain was not in India. Hussain’s lawyers have gone into appeal directly in the Supreme Court on this arrest warrant. But still Shri. Varkhedkar was not given a chance to plead. This transfer petition has not been even signed by M.F. Hussain. Presently, he is not in India. This petition has been filed by ‘Mukhatyar’ letter and one sided verdict has been passed and a stay order has been issued which is not as per the Indian Law.

All the issues have not been considered while issuing stay order. Shri. Varkhedkar stated that the case would be fought on the points like – unnecessary transfer of case to the Supreme Court when it could have been fought at the Court in Pandharpur. When an arrest warrant has been issued against Hussain, what was the need to provide police protection to him ? Was it not against the concept of ‘equality before law’? Shri. Varkhekar further said that Hussain managed to appeal directly in the Supreme Court through his representative although an arrest warrant was passed against him under the Sections 501 and 292 of the IPC.

The next hearing has been fixed on 4th September. A group of lawyers fought case on Hussain’s behalf and the Supreme Court without giving an opportunity to Shri. Varkhedkar, passed its verdict. Varkhedkar said that because Hussain has lot of money, he can afford to have so many lawyers to fight his case; but he did not have money. He said that even then he would go to Delhi to fight his own case. Shri. Varkhedkar said that it was a fight for righteousness and he was ready to sacrifice even his life for protection of religion and nation. The only problem is of money. That too, he would try to raise as per his requirement. He met Shri. Uddhav Thakare, the Managing Director of Shiv Sena. His response was positive. But on behalf of Shiv Sena, no legal aid has been extended to Shri. Varkhedkar so far.
